If upon confirmation your details are found not to be true (wholly or partly), Ubtan Story has the right in its sole discretion to reject the registration and debar you from using the Services of  and or other affiliated websites without prior notice whatsoever.

7. That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.

8. That before placing an order you shall check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale and invitation of offer included in the item's description.

CREDIT CARD DETAILS

 

You agree to provide correct and accurate credit/ debit card details to the approved payment gateway for availing Services on the Website. You shall not use the credit/ debit card which is not lawfully owned by you, i.e. in any transaction. You must use your own credit/ debit card. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation or court order. You will be solely responsible for the security and confidentiality of your credit/ debit card details. Ubtan Story expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of your credit/ debit card. Your payment card will be debited for your order on the day we send you the formal order confirmation. Ubtan Story shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction, on account of you/ cardholder having exceeded the preset limit mutually agreed by Ubtan Story with our acquiring bank from time to time.

DELIVERY SCHEDULE

 

A tentative delivery time will be given along with the formal order confirmation. The exact delivery date shall be provided as soon as your order is ready for dispatch.

RESTRICTIONS

 

Ubtan Story reserves the right, at our sole discretion, to limit the quantity/ value of the items purchased by you and such restrictions may be applicable to orders placed by the same account and also to orders that use the same billing and/or shipping address. We will provide notification to the customer should such limits be applied. Ubtan Story reserves the right, at our sole discretion, to prohibit sales to any one as it may deem fit.

CANCELLATION BY UBTAN STORY

 

There may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional information or verification/s before accepting any order. We will inform you if the entire order or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit/debit card has been charged, the said amount will be reverted back in your card account. We will seek authorization on your card for the aggregate amount of the order placed by you, however, we may charge your card (capture) only with the amount corresponding to the actual portion of the order that we are able/ willing to fulfill, and any associated shipping charges/ taxes and levies etc. Any surplus amount, for which we might have originally sought and received an authorization on your card from your Card Issuer, if not captured by us in the time period stipulated by our Merchant Banker, will not be captured/ charged. If however the same is charged to your card/ bank account in error, we will refund it as soon as the same is realized by us or brought to our notice, whichever is sooner. Ubtan Story reserves the right to capture/ charge your card to the full or partially authorized amount for the concerned order.

CANCELLATION AND CHANGES BY CUSTOMERS

 

If you wish to cancel or modify your order, please send an email to returns@ubtanstory.com.  While we will try to accommodate your request, we cannot guarantee cancellation or modification, once an order has been submitted.

SHIPPING POLICY

 

We are shipping pan India. We are not shipping internationally at the moment.

 

Note: At present, we do not have the option to deliver a single order to multiple destinations. You will need to place different orders for shipment to multiple destinations.

 

Shipping & Handling Charges: We provide free shipping for all orders above Rs. 3,000/- within India.

The free shipping will not apply to bulk orders.

 

Time to Deliver: The time taken for delivery tends to vary according to the destination, however, we make our best efforts to ensure that the order is delivered within 5-7 working days within India. 

 

We only partner with reputed courier agencies to ensure that the products reach you promptly and in perfect condition.

RETURN POLICY

 

A refund shall be provided if you cancel any order within 24 hours of having placed the order. However, once the order has been shipped we will not be able to cancel or modify it. We offer returns and exchanges for orders damaged in transit or if you have received wrong item(s). All decisions to cancel an order, refund, return or exchanges are at the sole discretion of Ubtan Story.

 

Refunds shall not be provided if: 

1. The products are returned in a used or damaged condition.

2. Incorrect or out-dated delivery address. 

3. After two failed delivery attempts by our respective courier agent.

4. Package refused by recipient.

5. Minor colour and texture variation. All products are handmade and use natural and fresh ingredients so there may be some variation from the photographs on our website in different batches.

DISCLAIMER  

 

All products are handmade using fresh, natural and in most cases organic ingredients obtained from local Indian farmers so there may be some variations in the actual product received. The texture, appearance, colour and fragrance may vary depending on extreme weather conditions. This does not affect the quality and effectiveness of our products in any way. All our bars are hand pressed and made using fresh natural ingredients. There may therefore be variations in shape and colour from the images displayed on the website.

 

Packaging of the product may vary from the packaging of the product displayed on the website. All products are subject to availability. We reserve the right to limit the quantity of products we supply, supply only part of an order or to divide up orders. We will inform you if we are unable to fill your order. Prices on the website are subject to change without notice, and can vary from product to product, and from time to time, depending on the price of raw materials at the time of production.

 

Although our products look and smell good enough to eat, may we remind you that they are only for EXTERNAL USE.

We are not liable for any delay in the performance or non-performance of any of our obligations hereunder and shall not be liable for any loss or damages caused thereby where the same is occasioned by any cause whatsoever that is beyond our control including but not limited to an act of God, war, civil disturbance, governmental or parliamentary restrictions, prohibitions or enactments’ of any kind, import or export regulations, exchange control regulations or accident or non-availability/ delay in transport.

 

 

FRAUDULENT TRANSACTIONS

 

Ubtan Story reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the site fraudulently. Ubtan Story reserves the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these Terms & Conditions.

 

 

TERMINATION  

 

This User Agreement is effective unless and until terminated by either you or www.ubtanstory.com. You may do so by (i) not accessing the Website; or (ii) closing your accounts for all of the Services that you use, where Ubtan Story has made this option available to You.

 

We may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Website. Such termination will be without any liability to www.ubtanstory.com. Our right to any Comments shall survive any termination of this User Agreement. Any such termination of this User Agreement shall not cancel your obligation to pay for the product already ordered from the Website or affect any liability against you that may have arisen under the User Agreement.

 

 

GOVERNING LAW AND JURISDICTION  

 

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Delhi shall alone have exclusive jurisdiction in any proceedings arising out of this agreement.

 

 

MODIFICATION OF TERMS AND CONDITIONS OF SERVICE

 

Ubtan Story reserves the right at any time to modify the terms and conditions of this User Agreement without any prior notification to you. You can access the latest version of the User Agreement at any given time on www.ubtanstory.com. In the event the modified User Agreement is not acceptable to you, you undertake to discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed and accepted to the modified terms and conditions and you undertake to abide by the modified User Agreement.

 

 

ARBITRATION  

 

If any dispute arises between you and Ubtan Story during your use of the Site or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of this Agreement, and the Privacy Policy or the documents they incorporate by reference, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by Ubtan Story. The place of arbitration shall be Delhi. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.

 

 

GENERAL

 

None of the provisions of this Agreement shall be deemed to constitute a partnership or agency between you and Ubtan Story and you shall have no authority to bind Ubtan Story in any manner whatsoever. If any clause of this Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the Agreement. This Agreement sets forth the entire understanding and agreement between you and us with respect to the subject matter hereof. At Ubtan Story’s sole discretion, it may transfer its rights and obligations (under this Agreement without your prior express consent). If you breach this Agreement, and the Privacy Policy or the documents they incorporate by reference and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the aforesaid. Notwithstanding any other provisions of this Agreement, or any general legal principles to the contrary, any provision of this Agreement that imposes or contemplates continuing obligations on a party will survive the expiration or termination of this Agreement.
